Real Estate & Title Services

From contract to closing — and every detail in between.

At Finley Stetson, our Title Services Department is thorough, responsive, and motivated to close deals — not lawyer them up. Hiring a real estate attorney for your closing costs roughly the same as a standalone title agent, but the value is considerably greater: you get an experienced legal team at the ready to negotiate contracts, provide legal advice, explain documents, and remedy title issues.

Christopher Finley is a licensed Title Agent with Attorneys’ Title Insurance Fund. He holds an LLM in Estate Planning from the University of Miami and represents REITs, developers, lenders, borrowers, investors, landlords, and tenants across Palm Beach and Broward County.

The Golden Access Advantage

Hiring the Title Services Department of Finley Stetson gives you “Golden Access” to an elite real estate law team. The cost of closing through a real estate attorney is comparable to the cost of using a standalone title agent. But the value is quite different.

At our offices, a real estate attorney is at the ready to negotiate contracts on your behalf, provide legal advice, give clear understanding of legal documents, and remedy title issues. A title agency with no affiliation with a real estate attorney can’t do any of these things. When something goes wrong, title agencies are left steering their clients to the offices of a real estate attorney. At Finley Stetson, your attorney is already at the table.

How a Real Estate Closing Works in Florida

If you are buying or selling property in South Florida, understanding the closing process can help you feel prepared and confident. Here is what a typical residential closing looks like when you work with Finley Stetson:

Contract to Closing. Once a purchase agreement is signed, we open the title file and begin the title search immediately. We review the contract for any issues that could affect your interests and advise you on deadlines, contingencies, and obligations.

Title Search and Examination. We conduct a thorough search of public records to confirm that the seller has clear, marketable title to the property. This includes checking for outstanding liens, judgments, unpaid taxes, easements, and any other encumbrances that could affect ownership.

Clearing Title Issues. If the title search reveals any problems — old mortgages that were never properly satisfied, HOA or condo liens, or errors in recorded documents — we work with the seller and their counsel to resolve them before closing.

Title Insurance. We issue title insurance policies to protect both the buyer and the lender against hidden defects that may not have appeared in the public records. This includes forgeries, undisclosed heirs, recording errors, and other risks that no title search can eliminate entirely.

Closing Day. We prepare the closing documents, conduct the closing, disburse funds, and record the deed and mortgage with the county. Our team handles every detail so that closing day is smooth and stress-free.

Most residential transactions close within 30 to 60 days from the date the contract is signed. Cash transactions can often close faster. We keep you informed throughout the process so you always know where things stand.

What Is Title Insurance and Why Do You Need It?

“Title” refers to the legal rights and responsibilities associated with a particular property. Before a property can be sold, the title must be “marketable” — free and clear of liens, encumbrances, and other defects. A title search examines public records to confirm marketable title, but some defects are hidden and cannot be found through a search alone.

Title insurance protects you against those hidden defects — problems like forged documents, undisclosed heirs, errors in public records, or liens that were improperly recorded. If a covered claim arises after closing, your title insurer pays the legal costs to defend your ownership and covers any financial loss.

Lenders require a lender’s title insurance policy as a condition of issuing a mortgage. We strongly recommend that buyers also purchase an owner’s policy for their own protection. The cost is a one-time premium paid at closing.

Why Use a Real Estate Attorney Instead of a Title Company?

In Florida, closings can be handled by either a title company or a real estate attorney. The cost is comparable — but the value is dramatically different. A title company can process the paperwork and issue title insurance, but it cannot give you legal advice, negotiate contract terms on your behalf, or represent your interests if a dispute arises.

When you close through Finley Stetson, your attorney is involved from contract to closing. We review the purchase agreement before you sign it, identify issues early, negotiate on your behalf, and resolve problems before they threaten the deal. If something goes wrong at the closing table, your attorney is already sitting there — not someone you need to find and hire at the last minute.

For the same price as a standalone title agent, you get an experienced real estate law team standing behind your transaction. That is the Golden Access advantage.
